From Shelter to Success: Mid-America Pension Rights Gets Results

Pro Seniors’ Mid-America Pension Rights attorneys assist individuals of any age to access the pensions they are eligible to receive, often overcoming challenges that make this difficult. Following her recent divorce, “Joan”, age 48, contacted Pro Seniors for help with obtaining a Qualified Domestic Relations Order (QDRO) to obtain pension benefits to support herself and her son. Although she was entitled to a share of both a retirement savings plan and a 401 (k) plan from her ex-husband, since she had fled the marital home she had been living in a domestic violence shelter with no income and no assets. QDROs were prepared and pre-approved by the administrator. When her ex-husband refused to sign the order, Pro Seniors’ Mid-America Pension Rights attorneys pursued a contempt motion with help from Legal Aid. QDROs were signed and processed. In March 2022, our client received her share of both accounts as lump sums in the total amount of $182,224 cash accumulated, $182,224 present value. These funds allowed “Joan” to leave the domestic violence shelter and obtain her own apartment and a reliable car.
